Rental Agreement Terms / Conditions

General:
Marina Bay will be ready for occupancy at 3:00 PM local time
on the beginning date of the lease and must be vacated by 10:00 AM local
time on the ending date of the lease. During high season, it may not be
ready by 3 p.m., your patience is appreciated. Arrival and Departure times are
to be strictly observed. Guests are to call the Reservation office toll
free at 800.397.5590 to confirm arrival and departure and to report any damage.
Marina Bay is a Non-Smoking Unit.

ONLINE RESERVATIONS:
Guests must reserve Marina Bay
using the online reservation system or calling our office. The box must be checked stating that
you agree to all terms and conditions or the online booking process will end.
Checking the agreement box
is recognized by law as your online signature and that you agree to abide by the
terms and conditions set forth in this agreement.
DOOR CODE and WELCOME INFORMATION will be emailed to the Guest
upon receipt of Payment In Full of all rental charges which is due within
30 days of arrival. This
email will contain the code to the keypad for the entrance lock as well as
additional information regarding your stay.
ADDITIONAL FEES:
A Cleaning Fee of
$80.00 must be added
to the total charges. You will be asked to add these fees during the online booking
process.
Additional Fees may also include;
damages beyond normal wear and tear - $$ Actual
Cost. Unreturned or broken keys - $15; Excessive Cleaning Fee - $80; Smoking Deodorizing - $80
PETS: No pets are allowed at
Marina Bay.
Special Needs: If
there is a special need, please inform us on the online reservation form.
SECURITY DEPOSIT and BALANCE DUE: An advance
deposit in the amount of 1/2 of the Total Charges (including
additional fees) is payable at the time this reservation is booked by credit card or
check. You will be asked to pay the advance deposit by Credit Card or
Check at the end of the online booking process.
The Balance Due must be paid in full 30 days before you arrive. If
a credit card is on file, it will automatically be charged on that date, or you can mail a
check to the owner. If you are booking
this within 30 days of arrival, the total amount is due at time of booking.
Upon
payment in full, an email confirmation will be sent itemizing all charges and
payments along with the door code.
Cancellation Policy:
Cancellations must be made via email: (1) that are made more
than (30) days prior to the check in date will forfeit a minimum processing
charge of $100.00. (2) that are made within (30) days of the check- in
date will forfeit a minimum processing charge of $200.
SEVERE WEATHER:
Once renters
have arrived, cancellations and/or early departures due to inclement weather or
water levels do
not warrant any refund of rent. Lake Martin's water level is Dam
Controlled and varies during the year. It is Renters responsibility to
check the current and 3 year history of water level at
www.lakemartin.com
prior to arrival.
Hurricane Policy and Tropical Storm Policy
We do
not offer any refunds for Hurricanes or Tropical Storms. We highly recommend
getting TRAVEL Insurance for your trip. It is up to the Guest to purchase
this coverage for their trip. Coverage is available for health and weather
related problems. Go to

Parking and Guests:
One designated parking slot #204 is available for the Rentor. Guests
may be invited for the day, but due to limited parking, the
total number of vehicles
must be limited to no more than
three (3).
Boats and Trailers:
One designated boat slip #204 is available for the Rentor. Absolutely no
trailers may be parked on Marina Bay property. Owner has provided, at no
charge, a covered boat/trailer
Storage unit C21 located at Blue Creek Storage,
located minutes away. Boats may be launched at
these locations.
Pool and Condo Association Rules: An Outdoor Pool is available for Guests
enjoyment. No glassware is allowed around the pool or outdoor tables.
The Marina Bay Condominium Rules are posted on the refrigerator and may differ
from bvr vacation rentals. i.e. Do not hang towels, etc. over the rails. Please
observe all Condo Association Rules. Use Pool at your own risk. No
LifeGuards are available.
Telephone Service:
No charge for local area calls or 911 assistance or Toll Free Numbers. All long
distance phone calls made from the house phone must use calling card. Cell
phone coverage may not be available. Contact your provider to verify
coverage for Dadeville, AL, Blue Creek area of Lake Martin.
Correspondence shall be by email at the address supplied during the
online booking process. Our office must be notified of any change to your
email address within 60 days of your arrival. If Guest is traveling or not
able to retrieve email, notify our office. Failure to do so will prevent
Guest from receiving the door code. Owners email address is

MAXIMUM NUMBER OF OCCUPANTS: Marina
Bay Condo is to be occupied by no more than 8 persons at a maximum. We will not
rent to vacationing students or singles under 22 years of age unless accompanied
by an adult guardian or parent.
VIOLATION OF THE MAXIMUM OCCUPANCY PROVISION CAN
RESULT IN SERIOUS HEALTH PROBLEMS DIRECTLY RELATED TO OVERUSE OF THE SEPTIC
TANK. VIOLATION OF THIS PROVISION
SUBJECTS GUEST TO SIGNIFICANT PENALTIES WHICH ARE NECESSARY TO PROTECT THE OWNER
BECAUSE OF THE FACT THAT THIS LEASE IS A SHORT TERM SUMMER VACATION RENTAL.
FALSIFIED RESERVATIONS: Any
reservation obtained under false pretense will be subject to forfeiture of
advance deposit and/or rental money and the party will not be permitted to
check-in.
Rentor
assures the Owner that the tenants will observe all
conditions and terms of this lease as to maintaining the premises in good
order and appearance and will conduct themselves in a manner inoffensive to
neighbors.
Rentor agrees that any tenant who is found using drugs or
allows others to use drugs on the premises will be immediately denied continued
occupancy at these premises.
Rentor
and/or their guests shall not disturb, annoy, endanger, or
inconvenience neighbors, nor use the premises for any immoral or unlawful
purposes, nor violate any law or ordnance, nor commit waste or nuisance on or
about the premises. If law enforcement officials are called, the lessee will be
charged all fees associated with the law enforcements fee structure. No
parties of any kind allowed.
Rentor agrees that during the term of this lease and such further time
as he/she occupies the premises, he/she will keep the leased premises clean and
free of trash, garbage, and other waste.
Rentor agrees to indemnify and save Owner harmless
from all liability, loss or damage arising from any nuisance or harm made or
suffered on the leased premises by the Rentor, tenants, or guests or from any
carelessness, neglect, or improper conduct of any persons entering, occupying or
visiting the leased premises. Not responsible for personal items left
behind. If requested, owner will mail COD.
The Policies and Procedures above are meant to
protect our guests and owners alike. All guests, are required to conform to all
Policies and Procedures. Violators are subject to eviction according to Alabama
Law.
CREDIT CARD AUTHORIZATION: I
understand and consent to the use of the credit card provided without original
signature on the charge slip. This Credit Card Authorization will not terminate until
30 days after leased premises are vacated. Charges
may include: damages beyond normal wear and tear; unreturned or broken keys;
excessive cleaning fees; extra cleaning due to pets.
Check-Out Procedures:
We know you are on Vacation and we truly do appreciate your business. We ask
that you abide by our Check Out Procedures so the cleaning crew can
prepare for the next guest who will arrive only
hours after you leave. If you leave the unit in great shape, the next family can
have access to the unit on time.
Check out procedures are as follows:
1.
Check-out time is by 10:00 am local time. Our managers and cleaners arrive at
10:00 am to start cleaning the unit.
2. Take
ALL
of the trash, including the kitchen, bathrooms, bedrooms to the Common Area
Dumpster at the end of the parking lot.
3. Put ALL
dishes in dishwasher, put soap in and turn on.
4. Put all
used towels in the tub and bed linens in the laundry room.
5.
Make
sure outdoor furniture is in original position.
6. Please leave the
Condo neat and orderly to avoid additional charges. If the cleaning crew finds
that the home has been left excessively dirty you will be billed for the
additional cleaning time at a rate of $50 per hour.
7. Turn off all lights, set the thermostat to 75 and lock all doors.
DAMAGES: You are
responsible for any and all damages that occur to the property or its contents
by you or any other member of your group while you are the registered occupant
of the property. In lieu of a security deposit we will keep your credit card on
file as a security deposit. If we discover that there has been damage to the
property or it's contents while you are the occupant, we will capture an amount
from your credit card to cover the cost of repairs. We will provide a statement of the damages and the cost of the repairs
after they have been completed.
If no credit card is on file, you will be billed by Invoice, payable within
30 days.
For Sale:
Marina Bay is for sale and new owner
reserves the right to cancel any rental agreement. If New
Owner desires to cancel any or all rental agreements, Rentor agrees with the
understanding that all monies paid towards a future reservation(s) will be refunded.
All future reservations will be cancelled.
